Hello there Chris,

Happy New Year to you. I apologize for taking awhile to reply to your message. As you may already know, I'm not at liberty to discuss specific details of the most recent infantile events pertaining to a certain ex-member (Gavin Koppel aka DJ Lyfe) of the band. But I will tell you that said ex-member has been stalking Chris Kilmore for the better part of 11 years now. He has also threatened violence at numerous other members of our organization. His juvenile behavior is a serious issue, and is being treated as such. (There are numerous restraining orders in place against him at the current time) Our continued hope is that this will just stop, and that he will move on with his life.

As for a response to the numerous claims made. Well, he did sue the band a few years ago and had more than a fair opportunity to argue his points in front of an impartial judge during the proceedings. (remember, anyone can sue anyone in this country for ANYTHING if they can get a lawyer to support their cause) The result? Well, He is still stalking and making threats. If any law-savy incubus fans were to see the actual judgement from the court (the court documents), it would be extremely embarrassing for him. His own actions are embarrassment enough, so there's really no need to make his embarrassment worse than it already is.

Now, some real news. Brandon has been showing his paintings, Ben has been making a solo record, during breaks from being repeatedly stalked and harassed, Kilmore has been jamming with friends and recording new music. Jose has been spending time with his beautiful daughter and playing alot of drums at home. I've been busy scoring 2 films (will tell more about them as they are finished) and trying to keep up with the frantic pace of Harvard. Rest assured, to all of our loyal fans, a new Incubus record is on its way...I can promise you that much.

And by the way, Dirk Lance has a new album out with his band Willie's Nerve Clinic. You should advise all interested incubus fans to go check it out and show him your support. It's great to see him making music again, and doing it for no other reason than because he loves it.

Band News

"This past Wednesday, a judge in Los Angeles Superior Court granted Chris Kilmore a 3 year restraining order against former band member Gavin Koppel. The order requires that Mr. Koppel stay at least 100 yards away from Chris and cease all contact and communications. It also requires that he give up any firearms that he may own and bars him from purchasing a firearm during the 3 year period. Violations of the restraining order can result in further prosecution and jail time for Mr. Koppel.

Our hope is that this restraining order will serve as a serious warning to Mr. Koppel that his recent actions and his actions over the last 12 years are unacceptable and that it is time for him to move on with his life.

On a more positive note, I’d like to take this opportunity to talk about what’s going on in the Incubus world. First off, Mike will be completing his second year at Harvard University at the end of May. Mike tells me that he has had a blast and its been an unbelievable experience but he’s ready to get back to making some great Incubus music with the rest of his band mates.

Brandon has been busy on the creative front as always. He recently returned from a trip to the Sundance Film Festival in Utah where he was exhibiting some of his artwork and paintings. In addition, Brandon has been quietly writing and recording some songs on his own which I’m hoping he will share with all of you in the near future.

Ben is working on a new album. The album will be titled "Burn The Tapes" and it will have a short accompanying DVD with Ashley Mendel and Sekou Lumumba joining me for some songs. Expect some tour dates to coincide with the release.

And finally, I’m very happy to announce that Brandon and Mike have been invited to speak at the Oxford Debating Society at Oxford University in the UK on March 4th. The list of speakers who’ve addressed the Debating Society includes some of the most important political leaders, scientists, sportsmen, actors and musicians of our time.

Now that should be a great ‘gig’. I understand that the last time Mike and Brandon hung out at Harvard, (the Oxford Univ of the US) they wound up singing a couple of songs at an Ivy League beer bash. I wasn’t there, that’s just what I heard. Should be fun I bet. Hopefully, one of our friends at Oxford will videotape it and share it online.

Kilmore Files Restraining Order...


Chris Kilmore has filed a temporary restraining order against Incubus' former DJ Gavin Koppel aka DJ Lyfe on behalf of himself and his girlfriend Alison Abiega. He had filed a restraining order against Koppel in 2003 as well.

Allegedly in the summer of 2009, Koppel visited the couple at their home in the middle of the night. On December 29, Koppel approached the couple as they exited a nearby store and “started in on a tirade about scratch records” and confronted Kilmore about the 2003 restraining order.

He then said that Kilmore would “get killed” if he didn’t lift the order and made more threatening comments like telling Kilmore to watch his house before trying to engage him in a fist fight. The altercation ended after the store’s owner came out, prompting Koppel to walk away.

Kilmore also believes Koppel had a gun in his jacket pockets during the heated confrontation and that the band’s former DJ is following him.

“Mr. Koppel has harassed me and other members of Incubus for the last 11 years,” the papers also stated. Koppel, who left the band in February 1998, continues to receive royalties from the records he was part of.

A hearing is set for January 27.
